Album2 is pleased to have you as a Member in order to help you build and preserve your family community and history.

The Editor of the service is Sveinung Dammen.

The use of the trial version of Album2 is absolutely free and there are no obligations to purchase.


A. MEMBERSHIP TERMS

  1. Album2's primary concern is to ensure the protection of your privacy on the Internet. In Album2, the content you provide, such as a file with photos, sound, text or video, remains your property. The content is strictly confidential and it will not be exposed to other companies or used for purposes outside Album2. This rule will be left unchanged by Album2 forever, so that you are always in control of the provided content.
  2. Your content is not published on the Internet if you have not explicitly asked Album2 to do this, through your selected settings. You are always in control over your files. You can control in detail who will have access to your photos. It is your responsibility to study how this access control works and to set the access level in accordance with your preferred choice. Album2 is not responsible for the consequences of any configuration selected by you on your access settings.
  3. If you change content that concerns other members, they will be informed about it. Likewise, you will be informed about the change of content that may concern you.
  4. If you send photos from Album2, this is done in your name, similar to other e-mail services.
  5. Currently you enjoy 100GB free photo storage. Album2 guarantees that any of your storage space already uploaded under this free storage policy will never be revoked due to a change of policy, or any other reasons, as long as it is used for private photos, and not for commercial purposes. Album2 reserves the right to reduce the unused free storage space after a warning notification.
  6. All registrations and doings made after logging in (with your e-mail address and password) are supposed to be done only by you. We strongly advise you not to share your password with anybody. It is advisable not to set the automatic logging in on any other computers but your own, and especially not public computers in public places! Album2 is not responsible for any consequences of situations in which your password is used by a third party as a result of your negligence. You must notify us on support@album2.com if you suspect any unauthorized use of your account.
  7. Upon a member's passing away, his or her content will continue to be stored unaltered in the Album2 database. Access will only be given, if such decision exists, to the persons specified in the deceased's last will. Any claim to remove material from the deceased's content can only be made by the deceased's relatives acting together, unless it conflicts with the express will or intention of the deceased member.
  8. Any content that Album2 considers to be offensive, intrusive of privacy, or a copyright violation, will be made inaccessible to other members. You are solely responsible for the provided content and Album2 cannot be held liable in case of any of the above mentioned situations.
  9. Album2 reserves the right to send you informational e-mails, containing content Album2 feels is relevant to you. Album2 may also allow advertisements to be included in these e-mails.
  10. Album2 has the right to change the terms set forth in this agreement upon one month's advance notification.
  11. Album2 cannot be used for commercial purposes without permission from Album2.
  12. Members who want to tag photos for public publishing on the Internet automatically accept the Additional Agreement regarding the conditions mentioned below.

B. ADDITIONAL AGREEMENT ON THE CONDITIONS FOR THE USE OF PUBLISHING FUNCTIONS, LIKE SLIDESHOW AND OPEN ACCESS

Album2 is not to be held responsible or liable under any circumstances for any content that members upload and publish. Therefore, please remember to:

  1. use Album2 for building and preserving your family (and friends) community and history
  2. comply with good Internet ethics
  3. comply with national laws
  4. be familiar with the Album2 directions on how to set access levels to your content
  5. do not publish photos or information about people without their explicit consent
  6. do not violate intellectual property law
  7. do not upload or publish pornography, campaigns against ethnic or racial groups or anything else that might be considered offensive or insulting to any others' personal integrity
  8. Album2 has the right to:
    • remove content upon a person's request
    • exclude a member for violating any condition(s) set forth in this agreement

C. END USER LICENSE AGREEMENT FOR FACE DETECTION AND TRACKING SOFTWARE

Pittsburgh Pattern Recognition, Inc. ("PPR") grants the undersigned licensee, Album2 AS, ("Licensee") a license to use its Face Detection and Tracking software (the "Software") pursuant to the following terms:

  1. LICENSE. PPR hereby grants Licensee a limited, non-exclusive, non-transferable, license to use the Software in object code only for internal use. PPR shall retain all right, title and interest to the Software including all patents, copyrights, trademarks, trade secret and other proprietary rights thereto. Licensee will not, nor allow any third party to copy, distribute, sell, lend, rent, transfer, convey, modify, decompile, disassemble or reverse engineer the Software. The copyright notices and other proprietary legends shall not be removed from the Software.
  2. DISCLAIMER OF WARRANTIES. PPR makes no warranties whatsoever with respect to the software whether express, implied or statutory including, without limitation, the implied warranties of title, merchantability, fitness for particular purpose, non-infringement or other similar warranties.
  3. LIMITATION OF LIABILITY. In no event shall PPR be liable to licensee for any direct, indirect, incidental, punitive, special or consequential damages related to licensee’s use of the software, even if PPR has been advised of the possibility of such damages. PPR’s total liability related to the software provided to licensee hereunder, regardless of the claim, shall not exceed total of $100
  4. CONFIDENTIALITY. Licensee acknowledge that the Software and related documentation is confidential information and contains trade secrets of PPR and Licensee will not disclose the Software and related documentation to any third party for any purpose.
  5. TERM AND TERMINATION. This Agreement may be terminated immediately by PPR in the event Licensee breach any provision contained herein. Licensee will, upon the termination of this Agreement, immediately destroy all copies of the Software. The provisions of Sections 2, 3, 4 and 6 shall survive termination of this Agreement for any reason.
  6. MISCELLANEOUS. Licensee acknowledges that the Software is subject to the laws and export regulations of the United States and Licensee to comply with all of such laws and regulations. Should any term of this Agreement be declared void or unenforceable by any court of competent jurisdiction, such declaration shall have no effect on the remaining terms hereof. This Agreement may be amended only by a written agreement executed by Licensee and PPR. The failure of PPR to require performance of any provision hereof shall in no manner affect the right at a later time to enforce such provision. This Agreement shall be construed in accordance with the laws of the Commonwealth of Pennsylvania without regard to its conflict of laws provisions.

The MEMBERSHIP TERMS, THE ADDITIONAL AGREEMENT ON THE CONDITIONS FOR THE USE OF PUBLISHING FUNCTIONS, LIKE SLIDESHOW AND OPEN ACCESS and the END USER LICENSE AGREEMENT FOR FACE DETECTION AND TRACKING SOFTWARE Additional Agreement will remain in full force and effect while you are an Album2 Member. You may terminate your Membership at any time, for any reason. Album2 may terminate your Membership at any time, without notification. Even after the Membership is terminated, the MEMBERSHIP TERMS, THE ADDITIONAL AGREEMENT ON THE CONDITIONS FOR THE USE OF PUBLISHING FUNCTIONS, LIKE SLIDESHOW AND OPEN ACCESS and the END USER LICENSE AGREEMENT FOR FACE DETECTION AND TRACKING SOFTWARE will remain in effect.
